Supreme Court Urges Fast-Track Courts for Gangster Trials — Calls for Holistic Reform to Safeguard Justice

Considering Pendency of 288 trials against gangsters, etc. There will have to be appropriate strength of courts to ensure that these cases can be aptly distributed and their trials can proceed on day-to-day basis. If such decision is taken by Apt Authorities, it seems to us that all pending trials can be brought to an end, for which some more directions like compulsory appearance of defence counsels, dispensation of adjournments and a time line for the purpose of conclusion of investigation, framing of charges may also be issued at appropriate stage”.

The bench observed that swift and decisive action—such as daily hearings in fast-track courts—could significantly accelerate the justice process. “If this proposal is adopted, these prolonged trials could reach their conclusion without undue delay,” the court noted.

The bench also emphasized the dire need for dedicated court complexes specifically designed to handle cases involving hardened criminals and professional gangsters. These facilities, it said, would not only speed up trials but also reduce reliance on bail, which often undermines public safety.

Further, the court stressed the critical importance of witness protection in gangster trials, highlighting that threats and intimidation tactics are frequently used to derail proceedings. It urged all stakeholders—including the Union Home Ministry, the Delhi Government, and the Delhi High Court—to take a holistic view of the infrastructure and security needs surrounding these cases.

Justice Surya Kant expressed deep concern over the rising threats to the rule of law posed by increasing criminal incidents in the national capital region. “Justice must not be sabotaged through delayed proceedings or manipulation of witnesses,” he remarked.

Echoing the sentiment, Justice Surya Kant added that while gangsters must be dealt with firmly, the response must always remain within the bounds of legality and due process.
