PIL Filed In Supreme Court Seeks Immediate Removal Of A Mass Gathering Of Farmers From Delhi Borders Citing Risk Of Spread Of COVID-19

A Public Interest litigation (PIL) has been filed in Supreme Court seeking immediate removal of protesting masses (Farmers), from Delhi-NCR boarders.
The PIL is filed by one Rishab Sharma, a law student, through Advocate Om Prakash Parihar states that the protesters are “posing hurdle from accessing emergency medical services.
The pleas avers that It is pertinent to note that in view of the prevention of the community spread of the pandemic disease Coronavirus (COVID-19) it is very necessary to remove the gathering and this protest is further blocking the roads for all the emergency/medical services which are very much required to be supplied within the territory of Delhi in order to stop the spread of coronavirus as the cases of coronavirus patients are increasing rapidly in Delhi and many people were frequently travelling to Delhi from different states in order to get treatment in big government hospitals situated in Delhi.
The plea demands that protesters be shifted to some other place and Delhi Boarders, which have been blocked due to the protests, be reopened. It further states that social distancing and mask wearing protocol must be implemented among the protest groups.
though the Police has allotted a dedicated place for the protestors to protest peacefully, but the protestors are not shifting/moving to the allotted place and in order to create trouble for the commuters they have blocked the borders. Furthermore, owing to their large number of protestors, the police is not able to control such a large gathering.
The lea further submits that the demonstration poses a threat to the spread of COVID-19. At the same time, people are also having trouble in travelling.
It has also been alleged in the petition that the authorities should be ordered to open the border immediately.
the farmers from 26.11.2020 have been protesting against the above-mentioned bills at the borders of Delhi. That on 27.11.2020 the Delhi Police allowed protesters to hold the demonstration peacefully at Nirankari Ground in Burari, Delhi, but despite that they have blocked the borders of Delhi and not allowing anyone to pass on these roads.
The protesters are seriously jeopardizing the health of all who are taking part in protest.
The PIL is filed under Article 32 and seeks an urgent hearing. The Delhi Police must be asked to open all the borders.
It is submitted that the coronavirus is affecting mainly elderly people and the protest at Delhi border is mostly consisting of elderly men and women including other age group people
It is further stated that of the ongoing protest at the Delhi borders, the roads have been blocked by the protesters and closed border points, which have affected vehicular traffic and people who are travelling to and from Delhi to get medical treatment in reputed government/private hospitals situated in Delhi are also affected. Further, considering the present situation in Delhi, the COVID-19 cases have been rising and this makes the transportation of essential medical equipment’s even more important, but because of these protests, the same is not possible
