Maharashtra Political Turmoil: PIL Filed In Bombay High Court Against Eknath Shinde

The PIL, filed through Advocate Asim Sarode and Ajinkya Udane, further sough the court to direct the rebel leaders to return to the state and resume their duties,
A Public Interest Litigation (PIL) has been filed before Bombay High Court seeking directive to rebel Shiv Sena MLAs and Ministers led by Eknath Shinde to immediately return to Maharashtra from Guwhati where they are currently camped.
The PIL Sought appropriate action against the rebel leaders for the “omission of duties and moral wrongs committed, leading to disrespect towards the public rights and good governance”
The PIL is filed by seven Citizens of Maharashtra, also sought a direction to the Shiv Sena-led Maha VIkas Agadi (MVA) government in the state to submit a detailed plan of assurance, detailing the process of governance in the absence of several of its ministers .
It is further submitted that citizen’s public rights are being ignored due to the current political turmoil that is taking place in the state of Maharashtra. It is causing public nuisance to the citizens who have elected them.
The petitioner further states that instead of working for the community, these rebels are aiming at securing personal gains by instigating internal disorder within the governance of the state.
The dirty politics at the cost of the public money that is being displayed to the nation and the state that a group of political leaders and a bunch of elected representatives or a political party is willing to go to any lengths to grab power and teach it’s rivals lesson. This isn’t good for democracy. Citizens haven’t elected leaders for such political drama and neglecting public rights.
It is also submitted that it has nothing to do with revolt of any political leader or party but is only concerned with the constant political instability the state, which creates a sense of insecurity among citizens.
The petitioners’ mentions that the Indian Constitution is the first public police of the nation which describes in what way the nation will function. The constitution of India is the Supreme law of India. The document lays down the frame work that demarcates the fundamental political code, structure, procedures, powers and duties of government institutions and sets out fundamental rights, directive principles and duties of citizen.
The constitution of the country provides the rules and regulation for the people and government office to work effectively. In other words, the Constitution defines the functioning of the political system of the country.
The petitioners says that they have nothing to say about the revolt of any political party leader or group of leaders but the issue of the constant unstable political environment which created by such politicians and repetitively shown in the form of bulletin on all news channels, the voices of unrest is a public nuisance to citizens. It creates a sense of insecurity for the citizens.
The PIL has the following prayers
- Direct the Respondent No.1 (Shinde) who is on unofficial leave with other ministers to return to the state and assume their duties.
- Appropriate action may be kindly taken on Respondent No.1 and through him other Ministers with him, for omission of duties and moral wrongs committed to disrespect towards public rights and good governance.
- The respondent no 2, 3, 4 and 5 may be directed to submit detailed plan of assurance mentioning the process of governance in absence of many Ministers.
- Any other order deemed fit may kindly be passed.
- The petitioners also submitted that according to the latest newspaper reports over Rs 3000 Crore is being spent on the rebel MLAs and through horse trading Rs 5 crore per MLA.
It further adds that this is the crucial time for the farmers. Providing those seeds, fertilizers on time, addressing their emerging issues are some duties casted on Agricultural Minister”But the Agriculture Minister for Maharashtra Mr.Dada Bhuse is in Guwahati.
It may be noted that only Eknath Shinde has been cited as a respondent in the PIL, other MLAs have not been made parties.However, the Shiv Sena, Congress and NCP political parties have all been cited as responsible
