Delhi District Court Frames Charges Against expelled BJP MLA Kuldeep Sengar under POCSO Act

Expelled BJP MLA Kuldeep Sengar has been charged with rape under various sections of POCSO Act by a Delhi Court.

The District Judge Dharmesh Sharma of the Tes Hazari Court also framed charges against Sengar’s accomplice Shsasi Singh for allegedly kidnaping the minor girl.

Charges have been framed against Kuldeep Sengar under IPC section120b (criminal conspiracy), 363 (Kidnapping), 366 (Kidnapping or including a woman to compel for marriage), 376 (rape) and section 3 and 4of the Protection of the Children from Sexual Offences (POCSO) Act.

The Apex court had recently directed the authorities to transfer the case to New Delhi. There are five related cases against Sengar and Others in the Unnao rape case.

The CJI- led bench had transferred the cases from CBI Court, to Delhi in the suo moto proceedings based on the letter of family of Unnao rape survivor seeking protection from intimidation by accused. The mother of the survivor had approached the Apex court last April seeing transfer of trail outside of Utter Pradesh citing intimidation by accused.

The growing criminalization of politics, slow pace of Judiciary and low trust in the police force are considered to be the influencing factors and challenges that have plagued the nation.

There was a country-wide outrage over the Unnao rape case.

According to the Charge sheet, on June 4, 2017, Singh had taken the girl to Sengar’s residence on the pretext of getting her a job and the MLA had allegedly raped her.

The rape survivor’s father died in Police custody a year after the rape.

Recently on July 28 car accident, two of her relatives died on the spot while she was critically injured.

The CBI after taking over investigation has booked 10 people for murder including Sengar, who is already in Jail.

The Court further ordered that trial in all these cases should be held on a day to day basis and completed within 45 days.
