Control Illicit Content On- Net, Regulate Minor’s Access to Social Media: PIL Filed in SC

A Petition has been filed in Supreme Court which seeks an age – based access control to social media and to devise a profile verification mechanism to eliminate illicit content on social media.

The “revenge Porn” concept is prevailing in the society and several nations have criminalized it but, in our country, there exists no such legislation.

The petition has been filed by Skand Bajpai and Abhyudaya Mishra, Law students of New Law College, Bharati Vidyapeeth Deemed University, Pune.

The petitioners prayed to institute proper investigation and legal proceedings against the users of social media profiles who are indulged in the advertisement, sale and procurement of illicit contents (CSAM Videos) and private graphic information and to ensure deletion of such content.

The petitioners further submitted that either formulate the law or amen the existing laws to increase the accountability of the intermediaries towards Indian Jurisdictions, encourage mandatory reporting of CSAM and further direct them to make the intermediaries liable with regards to the content featured on their platforms.

In order to curb the incidents of morphing pictures and videos online and engaging in revenge porn, it is urged that a gender-neutral legislation should be introduced and if anyone is found to impersonate the identity of someone must be prosecuted.

Other reliefs

(i)      Upgrade the National Education Policy and include Adolescent sex education as a compulsory subject, introduce a subject related to online safety, security and conduct.

(ii)     Frame appropriate law governing the verification mechanism of social media profiles along with curbing fake social media profiles including catfish accounts.
