BCI Recalls notice to Suhasini Sen over illegal advertisement of a website.

The bar Council of India (BCI) has recalled its resolution to issue a show cause notice and to Advocate Suhasini Sen for her alleged involvement in creating and running a website “toplawyersofsupremecourtofindia.com” which was found to be advertising advocates contrary to BCI rules. The website had categorised many lawyers practising in Delhi into three categories, including a category for “good junior lawyers “In its earlier resolution BCI was of the opinion that the website was in clear violation of rule 36, Chapter II, Part VI, Section IV of the Bar Council of India Rules which prohibited advertising of the professional activities and accomplishment of Advocates.
Ms. Suhasini Sen, Advocate has stated in clear words and has furnished explanation that she has absolutely no concern with the website in question. She has also stated that she has issued a notice to Mr. Raahul Trivedi, Advocate through registered post asking him to remove her name from that website or any other website that might have been created by him (the copy of said notice has been annexed with the reply).
Ms. Suhasini Sen, Advocate has clarified her innocence on some electronic media also. Her language has been very decent and her conduct deserves appreciation too.
Accordingly, the Council has considered the issue afresh, under circulation, and upon re-looking the matter, the reply and explanation of Ms. Suhasini Sen, Advocate and considering the office report, is satisfied that she was not aware of any such website and of her profile being posted on such website, as her profile details published therein, was also available on common domain on internet, as explained by her, and, thus, the Council is of the opinion that Ms. Suhasini Sen, Advocate has had no role in the creation/publication/promotion of the offending website and/or of her profile being published therein.
Thus, the Resolution of the Bar Council of India, dated 20.05.2020, resolving issuance of show cause notice to Ms. Suhasini Sen, Advocate has been hereby ordered to be recalled.
The resolution of the Bar Council of India dated 20.05.2020 with respect to agenda Item No.118/2020 stands modified to the extent that show cause notice shall now be valid only with respect to Mr. Raahul Trivedi, Advocate and the name of Ms. Suhasini Sen, Advocate shall be omitted from the resolution. The show cause notice sent to Ms. Suhasini Sen,Advocate on 24.05.2020 is hereby recalled and withdrawn. The explanation of Ms. Suhasini Sen, Advocate and her innocence is fully proven and accepted by the Council. Ms. Suhasini Sen, Advocate has not done anything wrong. Attention has been invited to some posts on the social and electronic media by one Mr. Gopal Sankaranarayanan, Senior Advocate on the issue of show cause notice to Ms. Suhasini Sen, Advocate. We have seen the reaction, the tone and tenor of the language used by Mr. Gopal Sankaranarayanan, Senior Advocate against Bar Council of India. Mr. Gopal Sankaranarayanan, Senior Advocate was in no way concerned with this issue. However, the language used by him against his own Institution cannot be said to be befitting the status of a Senior Advocate and a gentleman, which is the requirement of this noble profession.
