“Reasons of Pendency of Cases is Non-Filling Up of Judicial Vacancies” : CJI N.V.Ramana Retorts To Union Law Minister

Chief Justice of India Justice N.V. Ramana while expressing his views retorted to Central Minister of Law and Justice Kiren Rijiju pertaining to massive case backlogs in the country.

CJI and law Minister were attending 18th All India Legal Services Authorities meet at Jaipur.

Central law Minister said that “I appeal to all the state Legal Service Authorities to further intensify their efforts to provide legal counsel/aid to the under-trail prisoners so that maximum numbers of under trail prisoners are released on or before 15th August, 2022, while celeberating azadi ka Amrit Utsav”.

 He has also expressed concerns about the exorbitant lawyers fee obstructing the access to justice for common man.

Wealthy and resourceful people get good lawyers in Delhi Supreme Court many lawyers are unaffordable for common man.Courts are not only for privileged door of justice shall always be open for all.

CJI has further elaborated that in a country like India, legal aid forms a core aspect of the administration of justice. Administration of justice is not an act which is accomplished only within the courtrooms. It involves promoting and creating awareness about rights and facilitating social justice. It means creating a platform where parties can claim competing rights.

CJI also cited that the example of the National Legal Services Authority settling around 2 crore pre-litigation cases and 1 crore pending cases last year.

CJI has also voiced the same concern on earlier occasions too. Speaking at the joint conference of the Chief Ministers of the States and Chief Justices of the High Courts at News Delhi on April, 30, the CJI said the non-performance of the various wings of the executive and ambiguities in the legislations were contributing a lot to the case load of the judiciary.

CJI also urged the Union law minister to extend wholehearted co-operation to the Chief Justices, in their endeavour to strengthen the district judiciary unless the foundation is strong, the structure cannot be sustained. Please be generous in creating more posts  and filling the same, so that our judge-to-population ration is comparable to advance democracies”, the CJI said.
