CJI Surya Kant Defends Collegium System Against Uninformed Criticism

New Delhi, 22-7-2026-Chief Justice of India (CJI) Surya Kant recently addressed criticisms levelled against the Supreme Court Collegium, asserting that much of it stems from a lack of understanding regarding the judiciary’s internal workings.
Speaking at a felicitation ceremony for five newly appointed Supreme Court judges, CJI Kant highlighted that critics often overlook the Collegium’s evolution, its criteria for recommending judges, and the extensive deliberations involved in its decisions.
“The authority of the Supreme Court rests neither on the power of the purse nor on the force of the sword. It rests on the conviction that every litigant will receive a patient hearing, every argument fair consideration, and every decision will be guided solely by the Constitution and the rule of law. That trust is earned patiently over time”
“I can assure you that despite the casual criticism the Supreme Court Collegium sometimes faces, particularly from people who do not know the functioning of the judiciary and how the Supreme Court Collegium evolved, what kind of criteria it factors in, and the issues that are deliberated,” the CJI stated.
The CJI elaborated on the meticulous process undertaken by the Collegium when recommending judges for both the Supreme Court and High Courts, as well as for the appointment of Chief Justices.
He emphasized that the process considers a multitude of factors, including inclusiveness, diversity, a judge’s performance, length of service, previous judicial positions, and overall professional career.
CJI Kant expressed gratitude to the Collegium for its objective and merit-based approach in recommending the five new judges for elevation Justices Sheel Nagu, Shree Chandrashekhar, Sanjeev Sachdeva, Arun Palli, and V Mohana.
He conveyed confidence that these new appointees would excel in their roles and serve as exemplary leaders within the institution, supported by the Supreme Court Bar.
Praising the Supreme Court Bar, CJI Kant acknowledged the conventions highlighted by SCBA President Vikas Singh.
He particularly lauded the cordial relationship between the Bar and the Bench within the Supreme Court, noting its uniqueness compared to High Courts or district courts.
He also commended the Bar’s ability to provide effective assistance during Supreme Court hearings, despite limited time, and the Bench’s capacity to quickly grasp complex issues.
CJI Kant concluded by reminding the newly elevated judges of their profound responsibility to uphold public trust in the nation’s highest court.
He stressed that the Supreme Court’s role extends beyond resolving civil and criminal disputes to actively developing constitutional jurisprudence.
He expressed unwavering confidence that the five new judges would embrace this responsibility and continue to contribute their best to its furtherance.
