Three Years Rigorous Imprisonment to Two Accused Including a Public Servant in One of The Cooperative Group Housing Societies (CGHs) Cases

The Special Judge for CBI Cases, Rouse Avenue District Courts, New Delhi has sentenced Sh. Deen Bandhu Prasad, then LDC, Grade-IV working in the office of Registrar of Cooperative Societies, New Delhi and Sh. Ashutosh Pant (Private Person), both to undergo three years Rigorous Imprisonment with fine of Rs. 55,000/- each in connection with a case related to investigations undertaken by CBI into Cooperative Group Housing Societies matter.

            CBI had registered a case against the then Registrar of Cooperative Societies, Parliament Street, New Delhi and others on 30.11.2005 in pursuance to the order dated 02.08.2005 passed by Hon’ble High Court of Delhi in Civil Writ Petition No. 10066/2004 vide which CBI was directed to conduct thorough investigation of 135 Cooperative Group Housing Societies including Birla Udyog Employees CGHS Ltd., having its registered office at Sabzi Mandi, Delhi. It was alleged that the accused entered into a conspiracy during the year 2003-04 with a common object to cheat DDA for allotment of land to the Birla Udyog Employees CGHS Ltd on the basis of false list of 119 members forwarded to DDA by the Registrar of Cooperative Societies for allotment of the land. It was further alleged that in pursuant to the said conspiracy, Sh. Ashutosh Pant (Private Person) illegally started to control the affairs of defunct society Birla Udyog Employees CGHS Ltd. to facilitate its revival.

            After investigation, CBI filed charge sheet on 22.01.2007.

            The Trial Court found the said accused guilty and convicted them.
