Telangana High Court Dismisses Plea of TSPSC Against Allowing 4 Debarred Students For Group-I Exam

In a significant development the division bench of Telangna High Court, on Saturday dismissed a writ appeal filed by the TSPSC questioning a single judge order directing it to permit the four debarred candidates to appear for the Group-1 preliminary exam on Sunday.
A bench of Justice Abhinand Shivali and Navarappu Rajeshwaria Rao, which heard an appeal of TSPS, reminded the commission that the single judge took enough precautions by asking the authorities not to publish the result of these four candidates till a clear picture emerges.
The court observed that the guilt of the 4 debarred candidates, who were appearing for the test by TSPSC following their alleged complicity and arrest in the Group-I question paper leak case, “was not established by any Judicial Forum”.
The Court has further said that they cannot be prevented from writing the exams.
Justice P.Madhvi Devi on Friday asked the authorities to issue them hall tickets and allow them to write the exam. Stating that it would send wrong signals to lakhs of candidates, the TSPSC filed an urgent writ appeal.
The Commission’s standing Council ram Gopal Rao contended that the four candidates were working with TSPSC on a contract basis and were actively involved in the leak; Advocate Mahesh Raje appearing for the four candidates argued that they were only accused of committing the crime but not convicted debarring them based upon police report will be arbitrary.
