Swami Challenges Rahul Gandhi’s Citizenship in Delhi High Court

Delhi, August 16, 2024 – In a dramatic legal move, BJP leader Subramanian Swamy has approached the Delhi High Court, demanding that the Union Home Ministry address his petition seeking the revocation of Congress leader Rahul Gandhi’s Indian citizenship. Swamy’s petition calls for a judicial review of the Home Ministry’s handling of his complaint, which alleges that Gandhi holds British citizenship and a British passport.
Swamy’s plea, which is expected to be heard by the court next week, accuses Rahul Gandhi of violating Article 9 of the Indian Constitution. Article 9 stipulates that any Indian citizen who voluntarily acquires the citizenship of another country ceases to be an Indian citizen. Swamy argues that Gandhi’s alleged foreign nationality is a breach of this constitutional provision and the Indian Citizenship Act of 1955.
In his petition, Swamy has requested the court to direct the Home Ministry to provide a status report on the representation he filed concerning Gandhi’s citizenship. Swamy’s legal team, led by advocate Vishesh Kanoria, has criticized the Home Ministry for its inaction and failure to prosecute Gandhi, demanding an explanation for why Gandhi should not be stripped of his Indian citizenship.
Rahul Gandhi, who has served as a Member of Parliament for five terms, first representing Amethi from 2004 to 2019 before being defeated by BJP’s Smriti Irani, and later elected from Kerala’s Wayanad, has not responded to the Home Ministry’s inquiries on this matter. Gandhi’s current position as the leader of the opposition in the Lok Sabha underscores his significant role in Indian politics. The Congress Party, often referred to as the Grand Old Party, is a major political force in India, holding 99 seats in the Lok Sabha.
Swamy’s allegations also include claims that Rahul Gandhi set up a business in the United Kingdom and served as a director of the company, further suggesting links to foreign interests. This legal battle highlights the ongoing political friction and scrutiny surrounding prominent political figures in India.
