Supreme Court Issues Orders to All States Boards to Declare Class 12th Results by July 31

In a significant development the Apex Court on Thursday, issued an order to all state governments to notify the Scheme for assessment within 10 days from today and declare the internal assessment results by July 31, like the time line specified by it in CBSE and ICSE.

The court has said “We are passing the general orders for all boards. We direct the boards that schemes be formulated and notified in 10 days from today. A vacation bench comprising Justice AM Khanwilkar and Dinesh Maheshwari ordered.

The Supreme Court also observed that it was not possible to have uniform scheme of assessment for all state boards.

The Court further mentioned that we have interacted with learned counsel appearing for the State of Andhra Pradesh, and State of Kerala, who had filed affidavits stating that the board of concerned State has taken an in-principal decision to continue with the XII standard examination.

The bench was hearing a PIL filed by Advocate Anubha Sahai Srivastava seeking cancelation of state board exams amid COVID-19 pandemic situation. While the petition was pending several State, Governments had announced the cancellation of Class 12 exams. Six States have already conducted the class 12 exams. Only Andhra Pradesh is yet to hold the class 12 exams or to announce its cancellation. Andhra Pradesh state has submitted in the Apex Court that it is proposing to hold the exams tentatively in the last week of July.

The order further says as that “we make it clear that each Board may formulate its own Scheme. However, we further make it clear that we are not endorsing the correctness and validity of the proposed Schemes, to be so formulated by the concerned Boards.

During the hearing conducted through video conferencing, the bench was told by an Advocate appearing in the matter that state boards which have cancelled the class 12examination amid COVID-19 may be asked to have a uniform scheme for assessing students.

The Apex Court has expressed dissatisfaction with the stand taken by the Andhra Pradesh Government. And intensely grilled the state’s lawyer with respect to the decision. When other state boards, CBSE and ISCE have cancelled the class 12 exams, why can’t the Andhra Pradesh board also do so?? The bench asked.
