SCBA Calls Off Scheduled Meeting to Pass Resolution Against Senior Advocates Kapil Sibal and NK Kaul

New Delhi [India], March 15: The executive Committee of Supreme Court Advocates association has decided to cancel the General Body meeting which was supposed to be convened tomorrow to discuss the resolutions proposed against Senior Advocates Kapil Sibal and NK Kaul, for apologising to Chief Justice of India (CJI), D Y Chandrachud over a spat with SCBA President Vikas Singh.
In a letter to the members of SCBA the president of the Association Vikas Singh said that the executive committee of the Supreme Court bar Association on Wednesday decided to cancel its general Body Meetin, scheduled to be held tomorrow, seeking to censure Senior Advocates Kapil SIbal and Neeraj Kishan Kaul.
It is further stated that keeping in view the letter of former attorney General K.K.Venugopal and in the larger interest of the Bar, has decided to recall the Special General Body Meeting proposed to be held on 16 of March.
Furthermore 600 Lawyers including 70 Senior Advocates had also written to the SCBA to withdraw the two resolutions.
Since the Special Bench has been constituted to hear the case which lies at the heart of the issue, the resolution regarding solidarity of the bar with the same stands fulfilled, the communication said.
The executive Committee of SCBA, However, expects that any member of the Bar may refrain from making any statement contrary to the larger interest of the Bar, diluting the stand taken by the elected representatives of the Bar i.e. Executive Committee of SCBA.
One of the two SCBA resolutions in question had sought the issuance of show-cause notices to Sibal and Kaul for disagreeing with the manner in which Vikas Singh president of SCBA had mentioned a case before Chief Justice of India DY Chandrachud on March 2.
CJI had rebuked Vikas Singh after the senior counsel continued to persist mentioning the plea by the SCBA seeking conversion of land allotted to the Supreme Court as Chamber block for Lawyers.
On March 2. There was a heated exchange of words as the Chief Justice of India (CJI) DY Chandrachd lost his calm at SCBA President while hearing a land allotment matter relating to lawyers chambers on Thursday.
CJI DY Chandrachud did not appreciate Singh’s anguish while mentioning the matter which was not being listed despite several requests fro SCBA, CJI asked Vikas Singh to leave the court room.
Soon after this incident Senior Advocates Kapil Sibal and Kaul,who were waiting in the court for the shiv Sena case expressed apologies on behalf of the Bar for Singh’s outburst.
SCBA body said that as per rules, no member, individually or collectively, has a right of ask for withdrawal of a particular resolution but, the only right that a member has, whether individually or collectively, is to vote for/against the resolution at the time of the General Body Meeting.
