A Bombay base lawyer Ghanshayam Upadhayay filed a plea in Supreme Court prior to the alleged encounter of the gangster Vikas Dubey seeking for an investigation into the “Killing/alleged encounter” of his five co-accused by the Utter Pradesh police and hinted at the possible killing of Dubey.
The petition says that killing of an accused in police custody is in violation of rule of law. Regardless of how heinous the crime committed by the accused is.This is also a serious violation of human rights and “nothing short of Talibanization of the country”.
Dubey was on run since the Kanpur incident took place where eight police personnel were killed by the gangster.
The petitioner prayed that the matter be investigated by the Central Bureau of Investigation, under the supervision of the Supreme Court and that the same is ministered by the court. Thereafter strict action is to be taken against the policemen and all those are who are involved in the killing of the four accused.
The UP police had razed down the properties belonging to Dubey and the gangster’s aides had been killed in police encounters, the petitioner had sought for the direction for the authorities to register an FIR against the Police officials for these actions.
A direction was also sought for authorities to ensure that Dubey’s life is safeguarded and he is not killed by the Police. Apprehending this action an urgent listing of the plea was sought, lest it becomes infructuous. While the petition did not get listed before the Court today, Dubey was killed by the Uttar Pradesh Police saying that the gangster tried to escape.
