PIL fled in Delhi High Court Seeking CBI Probe into Alleged embezzlements of Welfare Funds reserved for Building Construction Workers.

A public spirited registered social organization, has file a PIL in Delhi High Court refraining the respondents to further misappropriate statutory cess funds of about Rs.3,200 Crores which is constituted exclusively for the benefit of registered construction workers, and immediately issue direction to start a CBI probe into this misappropriation.
The petition has been filed by Pt. Deendayal Upadhyay Smriti Sansthan (PDUSS) an NGO which has claimed in it’s petition that Delhi Cess funds has collected approximately Rs.3200/- crores.
The petitioners submit that during the present ongoing lockdown related relief works being undertaken by the petitioner organization for migrant workers. It was announced by the Delhi Government that Rs.5,000/- per month will be transferred to all that registered construction workers. When the Volunteers of the petitioner organization made enquires with the migrant construction worker regarding the relief, the workers revealed that none of them had received any amount from the government and they are not even aware about their entitlements and their registration as construction workers.
The petitioner further contended that” There is a deep-rooted nexus between the trade unions and outsourced board employees to carry out large scale illegal registration of non-construction workers as constructions workers by charging huge amounts with a condition that they should be paid 40-50 per cent of the benefit amount.”
In their petition it is also mentioned that “It is very shocking that authorities/Unions have registered lacs of non-Construction workers (Some of them Rickshaw Pullers, Hawkers, Factory workers, Tailors, House wives etc.)”
The petition Added;
“Further, these bogus registrations were carried out on the recommendations & certificate of 80-90 Unions which were registered recently in last 4-5 years.
These Unions are illegally charging Rs. 5,000-1000 for each fraudulent registration with the help of 150 outsourced staff of M/s. ICSIL Okhla, New Delhi (Outsourced Company) recruited by the above construction Board of Delhi. It is very shocking that how this systematic and organized loot is happening by Delhi Building and Other Construction Workers Welfare Board (DBOCWWelfare Board) headed by the Ministry of Labour, Govt. Of NCT of Delhi who is also the Chairman of Board.
The petition filed through Advocates Balaji and Yogesh Pachauri on Monday the plea was listedbench judge of Justice VK Rao which is now referred to the Division bench and listed the matter for further hearing of the PIL on June,16.
