PIL Filed In Supreme Court Seeking Protection Of Opposition Party Workers As Well As Free And Fair Conduct Of Forthcoming Elections In West Bengal

A Public Interest Litigation has been filed in Apex Court seeking protection of opposition party leaders as well as conduct of “free and fair” elections in the state of west Bengal.
It is submitted that the indulgence of this Hon’ble Court has become unavoidable as the continuous violation of fundamental rights, statutory rights and human rights in the State of West Bengal has reached its zenith and the State government and its police machinery is involved in such violations. No steps to prevent such violation of fundamental, statutory and human rights is being taken by the State government rather it is the State government and its machinery which is responsible for such brutal violation of rights in the State of West Bengal.
The plea is filed on behalf of Puneet Kaur Dhanda,filed through DR.J.P Dhanda seeks to issue appropriate writ or direction to the Respondent Election Commission of India to submit detailed report regarding bogus voters in the State of West Bengal and also direct the Election Commission of India and Election Commission of State of West Bengal to take an appropriate action in removal of those bogus voters from voters list of State of West Bengal assembly elections.
The further submits that many of the workers had been brutally killed and a CBI enquiry must be ordered to investigate in the cases involving deaths of opposition party. Workers and leaders.
It is averred that The Law and order and system of affairs in the State of West Bengal has collapsed beyond repair and the political party leaders including women other than the ruling party are being systematically killed for vested reasons and the same is a grave violation of Article 21 of the Constitution of India which says “No person shall be deprived of his life or personal liberty except according to procedure established by law” has been guaranteed by the Constitution of India.
The petitioner has also sought the Union of India to ensure safety of party workers belonging to the opposition parties and submit a detailed report regarding action taken i.e case status in killings of opposition party leaders, especially for those belonging to BJP.
The petitioner asks the Court to issue directions for a free and fair, peaceful and safe election in the state with the following prayers
a) Issue an appropriate writ or order or direction directing the Respondent No. to submit a detailed action taken report and case status in the cases of killings of opposition party leaders especially belonging to BJP before this Hon’ble Court.
b) Issue an appropriate writ or order or direction directing the Respondent No. to ensure safety of party workers belonging to opposition parties in the State of West Bengal during canvassing, casting of votes and counting of ballots for fear free and fair assembly elections in 2021.
c) Issue an appropriate writ or order or direction to the Union Home Secretary to ensure proper security in assembly elections of the State of West Bengal by deployment of paramilitary forces in the State to ensure free and fair elections in the State of West Bengal.
d) Issue an appropriate writ or direction to the Respondent Union Home Secretary and Director General of Police, West Bengal to take strict action against errant senior officers involved in dereliction of duty in protection of BJP party president who was attacked in West Bengal during his visit.
e) issue appropriate writ or direction to the Respondent Election Commission of India to submit detailed report regarding bogus voters in the State of West Bengal and also direct the Election Commission of India and Election Commission of State of West Bengal to take an appropriate action in removal of those bogus voters from voters list of State of West Bengal assembly elections.
f) Issue appropriate writ or direction to Respondent No. Director Central Bureau of Investigation to conduct a detailed investigation in the cases involving killings of opposition party workers and leaders in the State of West Bengal if the report submitted by the DGP, West Bengal not found satisfactory to this Hon’ble Court.
g) Pass an appropriate writ or directions to the Respondents for free, peaceful, safe and fair forthcoming elections in the State of West Bengal in 2021.
d) Pass any such other further order or orders as this Hon’ble Court may deem fit and proper in the circumstances of the case;
