Hathras Gang-Rape Case: PIL in Apex Court Seeks Transfer of Case Out of U.P and CBI/SIT, Probe
A Plea has been Filed before Supreme Court seeking for the investigation in the Hathras gang-rape case to be conducted by CBI/SIT under the direct monitoring of a sitting or a retired Supreme Court or High Court Judge.
That on 14.09.2020 when the victim was going to fetch fodder from her fields for her cattle the accused namely Sandeep, Ravi Ramu & Luvkush, brutally raped her beaten her up and broke her backbone, neck bone and cut her tongue. The deceased victim was after abduction Gang-raped by the accused persons from the Uppar Caste and after that strangulated and dragged with her Duppata and also chocked her tongue, who later found unconscious in her fields and then her father has admitted to her in local hospital at Hatras, UP thereafter she was shifted for better
treatment to Safdarganj Hospital Delhi where she was succumbed to her injuries.
The Petitioners further seeks the transfer of the trial from U.P to Delhi due to the Utter Pradesh Authorities as well as Government failed to take certain appropriate actions against accused persons and regarding one innocent female (Who belongs from scheduled caste) has been first raped thereafter brutally assaulted, even according to media report/medical report her tongue was chopped and her neck-bone and back bone has also broken by the accused persons (who belongs from upper caste).
The three petitioners before Supreme Court also pray that the trial in the case to be transferred out of Utter Pradesh to Delhi and for a direction from the Court to ensure there is a speedy trial.
The petitioners have raised questions about the role played by police personnel in the horrific case.
According to the petitioners on September, 14 2020, a 19 year old Dalit women was abducted from the fields and gang-raped by four men in Hathras U.P. the women was shifted to a hospital in Aligarh later she was shifted to Safdarjung Hospital in Delhi where she succumbed to her injuries on Septmeber,29,2020.
There after the police has forcibly taken the dead body of the Victim and the father along with them for cremation. When the father of the victim reached Hathras, he was immediately taken (to the crematorium).
As per the petition, senior police administration officials were also present at the crematorium in the middle of the night.
The petition is drawn by Advocate Pradeep Kumar Yadav and filed through Advocate Sanjeev Malhotra,
