Hate Speeches: Right Wing Hindu Groups Move Supreme Court Seeking Action Against Muslim Leaders for Hate Speeches

Reacting to the Supreme Court’s decision to look into hate speeches made by Haridwar and Delhi last year, two hindu right wing groups have filed petitions urging the court to investigate it by SIT into hate speeches against Hindus and Hindu Gods and Goddesses [Qurban Ali and other Vs Union of India and Others].

President Vishnu Gupta has demanded that Muslim leaders be arrested for their hate speeches instead. He further contended that the statements by religious leaders at ‘Dharma Sansad ’were in response to attack Hindu culture by non-Hindus, and cannot be described as hate speeches
The petition pending before Supreme Court was filed former Patna High Court Judge, Justice Anjana Prakash and Journalist Qurban Ali High-lighting the two separate events organised in Delhi (by the Hindu Yuva Vahini) and Haridwar (by Yati Narsinghananad) on 17th and 19th December,2021, wherein hate speeches consisting of open calls given for genocide of Muslims in order to achieve ethnic cleansing were made.
The 76 Practising Lawyers of the Supreme Court have urged the Chief Justice of Indian Justice NV Ramana to take suo moto cognizance of the same and issue directions for taking action against the guilty persons under Sections 120B,121A,124A, 153A,153B,295A and 298 of the Indian Penal Code, 1850 has also been made.

The present IA also sought directions to the State to register F.I.R against Asaduddin Owasi,Tauqeer Raza,Sajid Rashidi, Amanathullah Khan, Waris pathan for allegedly making hate speeches.
The IA refers journalist Qurban Ali who is the first petitioner in the case, the applicant urged that the petitioner who belongs to Muslim Community is not supposed to raise objections against the affairs or activities related to Hindu Dharm Sanasad.
According to the applicant, the organisation of Dharm Sansad by Hindu spiritual leaders cannot be treated as against any other religion or faith and ought not to have been objected.
It was further argued in the application that statements issued by Hindu spiritual leaders at Haridwar and Delhi were in response to attacks on Hindu Gods, and Culture and such replies not comes under purview of “Hate Speech”
The Application further submits that the constitution of India provides equal protection to the followers of all faith and religion, in this context reference may be made to Article19 (1)(a) and (b)read with Article
