Habeas Corpus: SLP Filed In Supreme Court Seeking To Trace Missing Man, SC Issues Notice To Malaysian High Commissioner

The Apex Court on Monday issued notice to the High Commissioner of Malaysia in a habease corpus petition filed by a wiffe seeking to trace her husband who had gone to Malaysia fro a job and has been missing since 2015.
A Bench of Justices UU lalit, S.Ravindra Bhat, and Bela M Trivedi on Monday issued notice .
The Court was hearing the SLP filed by one Raj Kumari who alleged that her husband and three others were abducuted by five Indian men in 2015 in Malasia.
The petitioner submitted that no action has been was taken on her representations to the Prime Minister’s office and external Affairs Ministry. And her complaints to the polic.
Later the petitioner approached the High Court, which dismissed the plea,leading to the present appeal before the top court.In the impugned order, the High Court dismissed the writ petitionof the petitoneron the groundthat the police is conducting an investigation.
The plea filed through Advocate Anuj Bhandari pointed out that the Rajasthan High Court dismissed her petition.
As per the petitioner, one Narendra Kumar Pachori had taken money from the petitioner’s husband Vijay Singh on the pretext of getting him lucrative jobs abroad. After taking money on multiple occasions. The petitioner’s husband was finally sent to Malaysia for a job in October 2014 on the promise of a monthly salary of Rs 45,000.
The petitioner had sought the Apex Court’s intervention to issue direction to find out the whereabouts of her husband and ensure his safety.
It is also submitted that petitioner has already approached Prime Minister’s office, NHRC, Ministry of External affairs and Local Police but no substantial action has been taken in this regard. The petitioner is not even aware if her husband is dead or alive in Malaysia.
The Supreme Court has issued notice to the High Commission of Malaysia and has sought a response from High Commission and the State of Rajasthan.
