Five Years Rigorous Imprisonment to Three Accused in A Case Related to VYAPAM Regarding Admission to MBBS Course

The Special Judge, CBI Cases, Indore (Madhya Pradesh) has sentenced S/Sh. Saurav Kumar Singh, Umesh Shrivastava & Pravin Singh Rathore to undergo five years Rigorous Imprisonment with fine of Rs. 8000/- each in a case related to Vyapam regarding admission to MBBS Course. 

            CBI had registered the instant case and taken over the investigation of the case earlier registered at Police Station Sanyogitaganj, Indore on complaint against the accused on the allegations that the accused had cheated a doctor (Complainant) and taken Rs. 13 lakh from him for getting his son admitted in Medical College at Indore through Management Quota. 

            Investigation revealed that the accused entered into a conspiracy to cheat the Doctor (Complainant) and assured him that they would arrange a seat in MBBS course under Management Quota through PMT and initially took Rs. 6.5 lakh in cash from him. It was further alleged that the accused took photograph, Marksheet of 10th class & signature of his son on a paper for filing up PMT-2011 Application form, which was filled up by one of the accused. In pursuance of the said conspiracy, the accused sent the scanned copy of the said PMT-2011 Application form along with Admit card to email ID of Doctor’s son. Thereafter, all the accused again visited Doctor’s house twice before examinations and took remaining Rs. 6.5 lakh in cash. It was also alleged that the accused did not manage to get admission of Doctor’s son in MBBS Course as promised and also they did not return the amount taken from him. 

During further investigation by CBI, it was established that the handwriting of accused matched with the handwriting available on the PMT Application form of the candidate. The email accounts of accused were verified and found the emails were used by them. It was found that a seat under management quota was to be availed only through the DMAT Exam conducted by APDMC and not through the PMT exam. It was also found that the Annual fee for the Govt. quota as well as the management quota was same for a private medical institute. The investigation revealed that accused had deceived and created a false impression in the mind of Complainant.

            After investigation, CBI filed charge sheet against 04 accused on 29.06.2015.

            The Trial Court found all the four accused guilty and convicted them. Sh. Setu Raj one of the four accused did not appear before the Trial Court and the sentence could not be passed. An arrest warrant has been issued against him.
