Fake-Feminism Has Polluted the Country Make Gender Neutral Laws to Reduce Crime Against Women: Law Students Move SC Seeking Gender Neutral Provisions on Sexual Offences

In the wake of the recent the fake feminism incidences which are on rise in the recent times, two law students have moved Supreme Court seeking directions for reconsideration and amendment of provisions under the Indian Penal Code relating to sexual offences against women, to make them; gender neutral’.

The petition is filed by two law students Anam Kamil

The trend of misuse of sexual offences laws by women is at rise in the country, where the respect ,honour, dignity of men’s are sabotage by the society mere because an allegation of sexual related offence is made.everytime the accused men’s gets acquitted but still the respect ,honour, dignity cannot regained

The petitioners pointed out that were made in the years 1860, 1956, and 1983 – an era when women did not really have much of a say in anything. At that period of time, men were said to be superior to women. That must have been the reason why all these laws are female oriented. But laws should be ever dynamic and must keep pace with the evolving social milieu.

The petitioners further contended that Laws should be amended in tune with the new normal. In today’s world, women are also harassing males and subjecting males to cruelty; as has been already established. The laws should be amended according to the present needs and situation in India.

The petitioners have sought directions to reconsider the laws for offence against women under IPC including Sexual harassment (254A-354D) Rape (Section376) Criminal Intimidation (Section 506) Insulting the Modesty of Women (Section 509) and cruelty to the women (498A).

The petitioners have following questions

QUESTIONS OF LAW –

A. Are the gender biased laws in IPC i.e., sec 354A-354D, 376,509,498a not contrary to the provision of article 14,15,21 of the constitution of India?

B. why the sec 128a of IPC is gender biased law, why the identity of accused man is not protected and is being viral which demolishes the reputation, honour and dignity of an individual framed in any case of sexual offences merely on an allegation?

22 C. what is the need of making gender biased laws when there is no gender inequality in India while there is various law for their rights?

D.is it not possible to cause sexual harassment, rape etc with men by a woman?

E. why there is no provision of taking stringent action against women who files false sexual offences cases against any men merely with an ill-will motives?

F. Whether the article 15(1) and 14 of the constitution prevails over art 15(3) and is there any requirement of art 15(3) after 71 years of constitution of India while the women are very far than men.

Citing the recent case from Lucknow where a girl was seen slapping a cab driver the petitioner has argued that trend of misuse of sexual offence laws by women is at rise sabotaging respect, honour, the dignity of men.

The petitioners have further submitted that the society and the legislature should recognize the crimes of cruelty and harassment being committed against males (especially married men). We may have more amendments like these in the future as well because with time, people’s mindset changes and with these changes occurring, changes in the law become inevitable. If changes in the law do not occur, our social milieu and the laws would not be consistent with each other. Laws and society should always run hand in hand. With a change in one, change in the other becomes indispensable.

According to the petitioner situation has worsened with the increase in the use of social media platforms which can easily be used to tarnish someone’s reputation. This is the way society perceives the women-centric laws that the women are always the victim and the men are always the perpetrator without understanding the true cause.

The petitioners have gone ahead and compared the impugned laws with decriminalisation of consensual gay sex and homosexuality in 2018, saying that in the same way, the society and legislature should recognise the crimes of cruelty and harassment being committed against men.

But what about a man who was charged with the offence of rape and is proven innocent. Does society treat him in the same way as they used to do before he was trapped in a false case? The answer is no.

Even if they are proved innocent, they are looked down by the people in the society who had already by themselves declared them as the perpetrator who deserves not to live with his head held high.
