Delhi HC Judges Watches the videos of BJP leasders,hate speech, asks cops to lodge FIR

Hate speeches delivered by Kapil Mishra,Anurag Thakur,Parvesh Verma and other BJP leaders, encouraging violence against anti-CAA protesters have been produced and played in front of the Judges of Delhi High Court.

A writ petition (PIL) by Activist Harsh Mander & Others and filed through Advocates Fazal Abdali Sneha Mukherjee and Nabila Hassan.

A division bench of the Delhi High Court Comprising Justices S.Muralidhar and Talwant Singh has heard the petition today.

This is so important that everything can wait, said Justice Muralidhar as he asked the counsel for the Delhi Police what his instructions were.

Expressing anguish, Delhi High Court has told the police that there should be no delay in registering FIRs against the speakers.

The Court said that the police should “Seriously consider the consequences.”

The court’s comment came after a tension-filled hearing in which hate videos of all the four BJP leaders were played during the hearing seeking filing of FIRs against those who incited and participated in violence that rocked Delhi for the fourth consecutive day today, leaving at least 27 dead and 200 injured.

The Court has given time till Thursday for police to take “conscious decision” on the matter and convey the same to the court.The Court has also said that “it would not concern itself with only those it had seen, noting, “All videos concerning this matter shall be communicated to the Commissioner.”

The Court has strongly conveyed that it “would not allow another 1984 scenario”. Referring to the bloody anti-Sikh riots that killed over 3,000 in Delhi alone.

Meanwhile the US Embassy has issued a safety alert to US citizens in Delhi, asking them to be cautious and aware of local news and section 144 imposed in certain areas of the City.

The petitioners seeks compensation for those killed, injured, preservation of CCTV footage, safety of women & Children, legal aid to those detained, deployment of Army in the area etc.

The petitioner has also prayed for constitution of special Investigation team (SIT) consisting of Officers from outside Delhi to look into the Violence and a direction to enable a retired Judge to enquire into the communal attacks.

The Division Bench has asked top state and Central government official to go and meet the victims.The Bench said that it is time to reach out to people urgently and assure them.

It also directed that a help line be set up for the victims and the Ambulance services be provided.The Court also directed that setting up night shelters and community halls with basic facilities like blankets, foods, medicine and sanitation for the victims.

Advocate Zubeda Begum has been appointed as amicus curie to co-ordinate between the victims and agencies providing medical assistance and safe passage to the victims.

The petitioners submit that the the local residents were participating in a peaceful and lawful demonstration and on other instances in past as per their rights enshrined under Article 14, Article 19 and Article 21 of the Constitution of India, UN Basic Principles on the Use of Force, Universal Declaration of Human Rights (UDHR) and International Covenant on Civil and Political Rights (ICCPR).
