CPI(M) Leader Brinda Karat Files An Application Supreme Court In Hate Speech Matter

CPI (M) LEADER Brinda Karat has filed an intervening Application in Supreme Court alleging that there were hate speeches by leaders of certain religious outfits which has caused a grave situation.

Brinda karat is a polit Bureau member of CPI (M), and a former Member of Parliament (Rajya Sabha).

In the main matter which is filed by a Journalist Shaheen Abdullah. This Intervention Application is filed

The Application is represented by AOR Subhash Chandran K R.

Brinda karat seeking to be impleaded in the matter she has filed a joint application  with KM Tiwari a socio-political activist who is currently acting as the Secretary of CPI (M)Delhi State Committee.

It is submitted that recently leaders of Vishwa Hindu Parishad, Bajrang Dal etc. have incited people against Muslim community in the name of Hindu Religion at public meetings held in various places in Delhi such as Nangloi, Ghonda Chowk etc. It is pertinent to mention that people were instigated against the constitutional values and secularism in the name of Hinduism. Such meetings are being held in different parts of National Capital and there have been continuous calls for economic and social boycott of Muslim community.

These speeches are clearly an offence under several Sections of Indian Penal Code such as 153A, 153B, 295A, 505(1) etc. But unfortunately, neither stringent action is being taken against such people by the Police and Administration nor are such meetings being stopped.

Court has been informed that according to an order passed by the court in October last year, wherein it had directed the police authorities in the states of Uttar Pradesh, Uttarakhand and UT of Delhi NCR to take suo Moto action against those indulging in hate speeches, the Supreme Court in April 2023, had directed all the States and Union territories across the country to do the same.

Earlier this month Senior Advocate Kapil Sibal had also mentioned a pleabefore CJI seeking action against calls made for boycott of Muslims Following the violence in Nuh, Haryana.

Sibal  had mentioned the plea saying there were  instances were individuals have been urged to label those who employ people from a specific community as ‘gaddars’ (Traitors).

On August 11, a bench led by Justice Sanjay Khanna said that a solution must be found for the problem of hate speeches. The bench also contemplated directing the DGPs to form committees with senior police officers to deal with hate speech complaints.
