(Judicial Quest News Network)
Justice Gautam Patel of the Bombay High Court has ordered an internal investigation after receiving a complaint from two lawyers that an order has been forged in his name.
“There is no manner of doubt that the entire document is not
only a forgery but a clumsy one”. said Justice Gautam Patel on February 15 after two lawyers filed a complaint that they had come across an order that they believe after a search of on HC website, was forged.
The high court observed that it was “disturbing” that the “purpose of forgery “was “evidently to create the rights in favour of the so-called petitioner… and to seek to make him the legal heir of two term deposits worth 51 lakhs”.
Justice Patel in his order now has said he would require the registrar to initiate criminal proceedings under section 195 of Code of Criminal Procedure (CrPC), if necessary, against person(s) unknown.
Justice Gautam Patil further stated in his order that..
“Satishchandra Goradia died just 15 days ago This order was
brought to the notice by the learned Advocates, Mr Upesh Vasant
Mohite and Advocate Ms Hetal Arvind Pandya by Mr Parth
Goradia, grandnephew (Satishchandra’s brother’s son’s son) u Parth
states that he obtained this document from his father, and that his
father in turn obtained it from one Mr Ashok Vageriyau on enquiries
with my Chamber staff today present in Court, we find that there is
no Advocate Ashok Vageriya registered with an Advocate’s code in
this Court’s system or records, nor is there a registered Clerk of any
such person The Complainants have enquired with Parth (Mobile
No 96994 68858) and he has provided the mobile number of Mr
Ashok Vageriya as 98333 59527u This is noted.”
Justice Patel has also directed for the personal presence of Advocate Vageria and Parth Garodia, the grandnephew of the beneficiary of the forged order, for an explanation regarding the forged document before the Court. Read Order Here..
