BCI Suspends Licenses of 28 Advocates of UP State Over Filing of Fake Compensation Claim Petitions

The Bar Council of India through its press release dated 22/11/2021 has decided to suspended 28 Advocates of UP indulged in the malpractice of filing fake claim cases.

28 Advocates whose names are listed in FIRs or charge sheets for allegedly filing fake claims before to Motor Accidents Claim Tribunal and under the Workmen Compensation Act. Have been suspended by the Bar Council of India 9BCI).

In it’s press release BCI has also directed the Uttar Pradesh Bar Council to initiate disciplinary proceedings against those Advocates’ State Bar Council was asked to conclude all inquiry within three months and place a report on the inquiry before the BCI.

The Bar Council’s action has come after the Supreme Court’s recent order directing the State of UP/SIT to forward the names of the advocates against whom prima facie cases of cognizable offences are disclosed filing fake claim petitions under Motor Accident Claims Tribunal and Workmen Compensation Act, so BCI could take action.

According to the press release, the council, after through discussion and deliberation, has resolved to put 28 Advocates under suspension.

A division bench of Supreme Court comprising of Justices M.R. Shah and Sanjiv Khanna on 16th November passed an order pursuant to which the present action has been taken up by the Council.

The bench took a serious note of the issue relating to Advocates involved in filing fake claim petitions.

The Court through its order dated 05-10-2021 requested the Chairman, Bar Council of India Senior Advocate Manan Kumar Mishra, to look into the matter.

On 16-11-2021, the Hon’ble Chairman, Bar Council of India had to state before the Hon’ble Supreme Court that the bar Council of Uttar Pradesh was not co-operating in sending the names of the Advocates who are indulged in such illegal activities of filing such fake claim petitions.

However, Mr. Manan Kumar Mishra assured the Court that if Bar Council of India receives the names of the Advocates involved in filing fake claim petitions the necessary disciplinary action shall be taken by the BCI against them immediately. Pursuant to such submission the court directed the SIT to send to BCI the list of Advocates, where upon such list was sent by SIT to Bar Council of India.

The press release has stated that the General Council of the Bar Council of India in its meeting dated 19th November therefore duly considered the Court’s order dated along with two lists.
