Andhra CM’s Press Conference Against Judiciary Is An Attempt To Tarnish The Majesty of Highest Court: Plea Filed In SC Seeks Against Him

A plea is filed in SC Soon after a letter was addressed to the Chief Justice of India SA Bobde making allegations of bias and judicial impropriety against a sitting judge of the Supreme Court by the Andhra CM YS Jaganmohan Reddy.
Filed on behalf of Sunil Kumar Singh, a practicing Lawyer, through Advocate on Record Mukti Singh,the plea seeks a stop on such press conferences by the Chief Minister against Judges and to issue “Show Cause Notice” to him as to why suitable action should not be taken against him.
The plea comes soon after the Principal Advisor to the Andhra Pradesh CM held a press conference on October 10 revealing that a letter was addressed to the Chief Justice of India SA Bobde making allegations of bias and judicial impropriety against a sitting judge of the Supreme Court.
The petition states that the public confidence in the court is at stake.
“In the society of today, where the discussion in the media and on social media can go wild within days or within hours, it can affect the image of judiciary and hence the confidence of the general public in the judiciary.”
Today criticism against the judiciary is expressed with less deference and more readiness than in the past. We have seen cases where it has been expressed not only by the parties to the proceeding or their counsel but also by the media the publisher or even by representative of executive or legislature.
The petitioner contends that Reddy has “crossed the limit” which has been prescribed by the Constitution.
It is also submitted that alleging corruption and bias against judges is prohibited under the mandate of the Constitution of India as provided under Article(s) 121 and 211. It further states that it is “mandated by the Constitution that no discussions shall take place in Parliament or in the State legislature with respect to the conduct of any judge of Supreme Court or the High Court in the discharge of his duty.
The Constitutional immunity is granted to the Judiciary is with purpose to allow them to perform their functions fearlessly.
Mentioning the incident “unprecedented” the petitioner states at the core of the concept of judicial independence is the theory of separation of powers. The “relationship between the three branches of the government should be one of respect.
The letter reads “ever since the YSR Congress Party gained power in May 2019 and ordered enquiry into all the deals made by the regime of N Chamndrababu Naidu from June 2014 to May 2019, Justice NV Ramana Started influencing the course of administration of Justice in the State.
The petition further prays for a show cause notice to be issued to CM Reddy as to why action should not be taken against him.
