Andhra CM’s letter to CJI: Direct Interference in the Administration of Justice, deserves appropriate Action; Former AP Judge Noushad Ali Writes to CJI

A former judge of AP High Court Justice Noushad Ali has written a letter to the CJI, SA Bobde mentioning the Orchestrated allegations against the second senior most Judge at the Supreme Court NV Ramana as the same is motivated by personal agenda.

In his letter to Chief Justice of India SA Bobde, Justice Ali expressed his distress at how the judiciary is being “Denigrated by the political and executive establishments.

Justice Ali has expressed his concern and opined that the Chief Minister’s letter to CJI Bobde and the allegations levelled against Justice NV Ramana therein have been for the purpose of influencing the minds of the trial court judges before whom cases against him (Jaganmohan Reddy) are pending.

Being deeply distressed over the deplorable events that are happening in the state of Andhra Pradesh, Judiciary being deliberately denigerated by the political and executive establishment, I support none but judiciary which all of us  hold in high esteem. Reads letter.

The letter also records that 31 cases are pending against Reddy‘s dealings in quid pro quo by Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED), further 13 cases against the Chief Minister were filed in different police stations, the Judges states.

Justice Ali pointed out  in his letter recently the Supreme Court had ordered expedite the trials odf cases concerning politicians as a possible spur to the Chief Minister’s attacks on the judiciary.

Justice Ali also emphasize that the CM’s letter and its timing are worthy to be noted

“That the timiong of the letter is worthy to be noted. Hon’bla Supreme Court through the Bench headed by justice Ramana p[asse orders on 16.9.2020 to expedite trial of cases. Concerning politician. On 6th October the Bench asked for some information to enable passing substantive orders to fast track long pending trial. The Chief Minister Letter is also dated 3.10.2020”

Justice Ali cites instances of Andhra Pradesh politicians “holding high offices” charging the judiciary with being influenced by former Chief Minister Chandrababu Naidu and Justice NV Ramana of the Supreme Court.

He further narrates that the attacks by the leaders were to gain favours with chief minister, but then realized that they were orchestrated under the directions of the Chief Minister.

Justice Ali also narrates that in his letter Reddy makes charges against orders passed by the Andhra Pradesh High Court in recent months, all of which are pending before the Supreme Court.

Justice Ali further says in his letter that “Circumstance that he being an accused in potentially serious cases without disclosing these facts and attacking the senior most sitting judge of the Supreme Court and addressing letter to no other than Chif Justice of India for action would possibly mount pressure on the learned Trial Judge, in Hyderabad.”

 His letter is double edged, that if orders are passed as desired in his favour he would stand vindicated or else he can go to the public that Supreme Court is also against him.

The propriety and the nature of letter seeking administrative intervention of the Hon’ble Chief Justice has to be examined in the light of the challenge of the same allegatios on the judicial side of the court.This amounts to direct interference with the Administration of Justice.

Lastly he claimed that Andhra CM Reddy had “ Orchestrated attacks”onn the judiciary through all the all the Assembly speaker, Ministers and legislators in his government, so as to lower the public confidence in the judicial institution.

A striking feature of the complaint details of which were revealed to the medi in a press by Ajeya Kallam, the Advisor of the CM. was that it had accused Senior Supreme Court Judge, Justice NV Ramana, who is next in the line to be Chief Justice of Idia, of influencing the administration of justice in the Andhra Pradesh High Court.
