Plea in Supreme Court to Beef Up CCTV, Virtual Presence of Criminals in Courts, Seeks Directions for The Protection of Judicial Officers and Legal Fraternity

In wake of yesterday’s firing incident in Rohini Court, an intervention application was filed through Advocate Vishal Tiwari seeking directions concrete steps for protection of the Judicial officers, advocates and legal fraternity.

Earlier on Tiwari mentioned such incidents from the different parts of the country including Bijnor, Barwani, Amritsar and Hisar to contend that such violent incidents are not uncommon in lower judiciary.

It is submitted that the Petitioner is filing this urgent Application for directions in the pending Writ Petition No. (CIVIL) PIL No. 867/2021 Public Interest Litigation filed under Article 32 of the Constitution of India praying for a writ of Mandamus or any other appropriate writs seeking issuance of specific Directions, policies and regulations initiate guidelines and directions for the protection of the judicial officers, Advocates and legal fraternity as a whole.to enforce the Right to life and Safety enshrined under Article 21 of the Constitution of India.

It is pointed out that the Subordinate courts in our country have been on several occasions turned into a place of crime as recently on 24-9-2021 the Shoot Out in Rohini court of Delhi is an example. Two armed men opened fire inside Delhi’s Rohini court on Friday, killing dreaded jailed gangster Jitender Maan alias Gogi. Members of the Delhi Police Special Cell’s Counter Intelligence team, who were accompanying Gogi, shot dead the assailants, with 27 bullets in all fired inside the courtroom. In a major security lapse, the men — believed to belong to a rival gang headed by Sunil, alias Tillu Tajpuriya — managed to sneak into the courtroom with a .38 bore pistol and another of .30 bore posing as lawyers. Gogi received five-six bullet injuries, and was taken to a nearby hospital, where he was declared dead.

According to the sources, the incident took place inside the court room207, where Gogi, an under trial, was produced on Friday morning while two men waited in the guise of lawyers. They were stated to have shot and killed him. The Delhi police then opened fire in retaliation and killed the two assailants.

That Such incidents are not only threat to our Judicial officers, lawyers and people present in the court premises but it is also threat to our justice system. The court is a place where people are in the shelter of law but they fall victim in courts of unlawful Activities, the plea said.
